Odometer Disclosure: When Wisconsin Requires It

The short answer: When you sell a car, federal and Wisconsin rules generally require you to disclose the odometer reading at transfer — recorded right on the title. But older vehicles are exempt: under the rule effective January 1, 2021, model-year 2011 and newer vehicles need a disclosure for 20 years, while model-year 2010 and older vehicles are exempt. So for many junk cars, no disclosure is required.

This is a small piece of signing over a Wisconsin title and part of the documents you need to sell a car.

What an odometer disclosure is

It’s a statement of the vehicle’s mileage at the time of sale, provided by the seller to the buyer — for most vehicles, entered directly in the odometer section of the title. It exists to prevent odometer fraud (rolling back mileage).

When it’s required vs exempt

The federal exemption age was extended in 2021 (NHTSA), so the old “over 10 years” rule of thumb is out of date. The current rule:

  • Model-year 2011 and newer: odometer disclosure required for 20 years from the model year. (A 2011 vehicle isn’t exempt until 2031.)
  • Model-year 2010 and older: exempt — no formal disclosure required.

Many end-of-life junk cars fall in the exempt range, but a 2011-or-newer vehicle still needs its mileage recorded at transfer.

How to record it

When disclosure applies, write the actual mileage in the odometer area of the title as you sign it over. If the odometer is broken or has rolled over, note that accurately using the title’s options (e.g., “not actual mileage” / “exceeds mechanical limits”) — don’t guess a clean number.

For a junk car specifically

Because so many junk cars are model-year 2010 or older, odometer disclosure often isn’t a hurdle at all. When it does apply, the buyer completes the title transfer with you, including the odometer line.

Frequently asked questions

At what age is a car exempt from odometer disclosure?

Model-year 2010 and older vehicles are exempt. Model-year 2011 and newer need a disclosure for 20 years from the model year — the cutoff was extended by NHTSA effective January 1, 2021, so don’t rely on the old “10-year” figure.

Do I need an odometer reading to junk an old car?

Often not, if the car is model-year 2010 or older (exempt). When disclosure does apply, record the mileage on the title.

What if my odometer is broken?

Disclose it honestly using the title’s options (e.g., “not actual mileage”). Don’t estimate a false reading.
